The Antimonopoly Committee of Ukraine will not be able to restrain the price growth at the fuel stations. Recently the Committee summarized the returns of the investigation against the major oil trading companies. No sensation happened. The Antimonopoly Committee of Ukraine acknowledged that it could not prove the fact of anticompetition concerted actions from TNK-BP Ukraine, LINOS (Lisichansk), "LITASKO-Ukraine" (Odessa), "LUKOIL-Ukraine" (Kiev) and "LUKOIL the Odessa Oil Refinery» (Odessa).

The President of Ukraine Viktor Yushchenko has abolished his own decree which was issued in May of the current year aimed at creation of the working group for analyzing of the problems in the oil industry. The document does not contain any reasons for abolishing of the decree. It has been mentioned that the President of LLC TNK-BP Ukraine Alexander Gorodetsky was one of the members of the working group.

The price of the Ukrainian oil has reached the record level for the last five years: at the auction of the Ukrainian Stock Exchange one ton of black gold was sold at UAH 2283,71. The market participants and the experts assert that this is one of the signs of the coming escalation of prices for the fuel. By the end of the month the prices for the gasoline and the diesel fuel will grow by 10-15%.

On July 26 the Minister of Fuel and Energetics of Ukraine Ivan Plachkov had a meeting with the top managers of the major oil companies of the country, dedicated to the situation at the oil products market. From the oil companies the meeting at the Ministry of Fuel and Energetics was attended by the First Vice-President, Managing Director of TNK-BP Ukraine Sergey Lisunov. The top managers of the companies told the Minister, that they would be forced to raise the selling prices for the oil products at least by 10% due to the fact that the State Tax Administration of Ukraine did not refund the VAT.

The Russian oil companies have forgiven the Ukrainian politicians and, by all appearances are ready to start relationships from the very beginning, just as they were urged to do this a couple of months ago by the President of the country Viktor Yushchenko. Apparently, the businessmen believed in his promises to keep only market relations henceforward and to refuse from administration methods of regulation. Besides, they were not anymore worried for their property which is in Ukraine and intend to realize large-scale investments in the region.

However, the team of the top managers of TNK has to be given their due. They worked out a strategy of withdrawal of the company from the crisis, stabilized the work of the plant and increased the amount of oil processing by a factor of 11, the production of gasoline by a factor of 14, the production of the diesel fuel by a factor of 8. Their network of fuel stations expanded to 1066 units by the last year, which made about 18% from the whole number in Ukraine.

The prices for fuel in Ukraine will grow at least by 5% in a month. These are unfavourable forecasts of the oil trading companies. The Government cannot keep the situation under control. The administrative pressure exerted on the foreign owners of the oil refineries did not prove effective. For the last month the prices for the gasoline and the diesel fuel in Ukraine have grown by 10%. The experts assert that the price growth would be much more significant, if it would not have been for the ample quantities of fuel at the market.

"LUKOIL" has shutdown the Odessa Oil Refinery and plans to modernize it to the European level. The construction works will last for three years, but the oil companies are sure, that this will not reflect on the fuel market, and Ukraine is not threatened with another gasoline shortage. However, the observers do not rule out, that for three years the picture in the oil industry could be profoundly changed.

Almost all fuel stations sell the A-95 gasoline at UAH 3,50. Such price was predicted by the experts still two months ago. Such scenario was depicted by the Minister of Economy Sergey Terekhin when he was speaking about consequences of removal the manual management of the oil products market. The first objective reason is the oil price increase at the world markets. 10% growth of prices for crude oil in one month will for surely reflect on the ready made products.

Thus, the fulfillment of all privatization obligations by the company has been confirmed.

In five years after the Lisichansk Oil Refinery was purchased by the Russian company TNK-ÂÐ, the State Property Fund of Ukraine acknowledged, that all conditions of the agreement for sales of the shares had been fulfilled by the investor. Having invested the amount required by the investment obligations, TNK-ÂÐ will continue to make investments further – for improving of the processing and selling assets. In the coming five years TNK-BP intends to invest in LINOS not less money than in the previous five years – $120 mln.

The Minister of Finance is forced by different circumstances to obtain patience, endurance and profound resourcefulness. The main financial agency of the country has to get down to such plain work as purgation of Augean stables, which were left by those who ruled the country in the previous years. For example, inspection on repayment of the credits, which were taken by the entrepreneurs under guarantees from the previous Governments. As a result the Ukrainian Cabinet signed an agreement with the Open Joint Stock Company "Lisichansknefteorgsintez" about repayment of the debt under the credit from "WestLB Westdeutsche Landesbank", attracted under the guarantees from the Government.

The Russian-British company completed fulfillment of the investment obligations on privatization of the Lisichansk Oil Refinery. The company has paid over $115 mln to fulfill the conditions of the contract for sales of the shares. In the nearest time the company plans to develop infrastructure and sale projects. On Friday the State Property Fund of Ukraine and the Closed Joint Stock Company "TNK-Ukraine Invest" (legal successor of the Company with Foreign Investments "TNK-Ukraine") signed an act of the final inspection of fulfillment of the conditions of the contract for sales of 67,41% shares of the Open Joint Stock Company “Lisichansknefteorgsintez” (Contract # 271 from July 18, 2000). Thus, fulfillment of all privatization obligations imposed upon the company was confirmed.

The Deputy Head of the State Property Fund of Ukraine Alexander Potimkov informed, that the Fund had acknowledged as fulfilled all investment obligations, undertaken by the company TNK-Ukraine when purchasing 67,4% shares of the Lisichansk Oil Refinery in 2000. According to Alexander Potimkov, now the Lisichansk Oil Refinery cannot be reprivatized by the State.

The State Property Fund of Ukraine officially confirmed fulfillment by the group of TNK-BP of the investment obligations, undertaken by the company when purchasing in 2000 the majority holding of the Lisichansk Oil Refinery. Thus, one of the major threats of the company's functioning in Ukraine was eliminated, since the positions of TNK-ÂÐ at LINOS, as the owner now became practically invulnerable.

Out of six Ukrainian oil refineries, which were sold during the years of independence, five have fulfilled its investment obligations. For example, the owners of the Lisichansk Oil Refinery have spent for five years $115 mln for observation of the conditions of the agreement of sales of the plant. The Executive Vice-President in charge of downstream operations TNK-ÂÐ Anthony Considine informed that in the course of five years the company planned to expand the network of own fuel stations from existing 51 up to 150 units. At the same time the representatives of the company refused to name the amount of possible investments in development of the network. On Friday the State Property Fund of Ukraine repeatedly confessed to the journalists, that there was no reprivatization in Ukraine. "We have researched the international market. "It is senseless to frighten somebody with crises. We do not rule out price fluctuations. There will be no sensational denunciations of the oil trading companies, who simultaneously and suddenly raised the prices for the fuel in spring. Having conducted the investigation about possible price conspiracy between the players at the market, the Antimonopoly Committee of Ukraine returned a verdict: the procedure of the case should be closed due to failure to prove such actions. The Ukrainian Prime-Minister Yuliya Timoshenko found herself in somewhat delicate situation: it was she who declared about malevolent actions of the oil traders. The Antimonopoly Committee of Ukraine has found violations of the Act on the Protection of Economic Competition; though these were though so minor, that their publication reminded rather reading of the absolution.

There will be no shortage of high-octane fuel, assert the oil processing companies. One of the largest domestic oil refineries purchased and installed unique equipment. Now TNK-ÂÐ will supply to the Ukrainian customers the fuel of further improved quality. The company has installed an isomerization unit at the Lisichansk Oil Refinery. President of LLC TNK-BP Ukraine Alexander Gorodetsky stated that the oil prices in August 2005 will be higher than in July. "Firstly, in August Russia raises the oil export duties when exporting from Russia to Ukraine. Secondly, it is already known, that LLC "LUKOIL" plans to shutdown the Odessa Oil Refinery for a major overhaul, but there is no information whether the Drohobych Oil Refinery will start working. The issue about the Kherson Oil Refinery remains as well open", - noted Alexander Gorodetsky. The Lisichansk Oil Refinery belonging to the Russian-British company TNK-BP which is the second biggest oil refinery in Ukraine in terms of capacity has commissioned an isomerization unit for light gasoline fractions with the rated output capacity about 300 000 tons per year. Commissioning of the unit will allow the Lisichansk Oil Refinery to increase the share of the high-octane gasoline in the overall amount of the manufactured products.

The Russian-British oil company TNK-ÂÐ plans to invest $150 mln in LLC "LINOS" until 2010. The other day the management of the company TNK-ÂÐ presented another novelty to the country. This novelty was an isomerization unit at LINOS, which can increase the output of the high-octane gasoline. The Governor of the Lugansk Region Aleksey Danilov believes that the absence of any accidents at LINOS for the last 20 months is an achievement. This information was revealed by the Press Department of the State Administration Office. He as well noted that LINOS comprises three parts which constitute the business policy - publicity, openness and legality. "Besides, the business ethics and culture of mutual relations between the partners are very vital", - underlined Aleksey Danilov. The Russian-British oil company “ÒNÊ-ÂД has erected and commissioned an isomerization unit for gasolines at the Lisichansk Oil Refinery. The rated production capacity of the unit makes 300 000 tons of oil products per year. The President of LLC “TNK-BP Ukraine” Alexander Gorodetsky informed that the construction of the isomerization unit was one of the biggest commercial investment projects of ÒNÊ-ÂÐ at “LINOS”. He noted that the overall cost of the project amounted to almost $20 mln.

Yesterday the Antimonopoly Committee of Ukraine closed the investigation against the biggest oil processing companies of the country which was started in May 2005. The representative of the Antimonopoly Committee of Ukraine stated that no conspiracy between the Ukrainian oil refineries was established, and the growth of prices for the oil products and resulting fuel crisis were evoked by “objective reasons”. The Press Department of the Ukrainian Cabinet refused to comment on the decision of the Antimonopoly Committee of Ukraine. Most experts believe that this decision was very much influenced by the position of the President of Ukraine Viktor Yushchenko, who declared one month ago that “there was no conspiracy, and the prices for the oil products rose quite objectively”.

Vigilant eye of the Antimonopoly Committee of Ukraine nevertheless found violations in the activity of the oil companies. Aleksey Kostusev accuses the managers of ÒNÊ-ÂÐ Ukraine that they had been submitting to the Committeeinadequate information about business trips of the company’s employees. However one question arises: how can it be related to suppression of the competition? It is quite uneasy to ascertain how the business trips of TNK’s employees can threaten the free fuel market.

The inspection which lasted two months did not produce a single fact testifying about illegal price increase for the gasoline and the diesel fuel. However, the Antimonopoly Committee of Ukraine imposed penalty provisions. Aleksey Kostusev is reserved when commenting on the decision of his Committee. He mentions some serious but not yet established arguments against the oil companies and at the same time he is admired by Yuliya Timoshenko’s actions during the fuel crisis.

But nevertheless the Antimonopoly Committee of Ukraine imposed a fine in amount of UAH 300 000 upon TNK for other minor violations. The price of the Ukrainian oil reached the record level for the last five years – on Friday the price has grown by 10% at the auction of the Ukrainian Stock Exchange (up to UAH 2 283,71 per ton). The oil companies believe that the record growth of the prices for the Ukrainian oil can serve as the base for the future price growth for the oil and the oil products in the country.

On July 14 the Ukrainian Government and Open Joint Stock Company “Lisichansknefteorgsintez” (“LINOS”, the Lugansk Region) signed an agreement on paying off the debt in amount of EUR 52,3 mln to the State Budget arising from fulfillment by the State of the obligations under the state-guaranteed credit from the German Westdeutsche Landesbank (West LB) to "LINOS".  "In fact, it is for the first time that such a huge indebtedness is repaid to the State. Earlier such credits were not returned and had to be repaid at the expense of the State Budget", - stated the Press Department of the Ministry of Finance.

The Head of the Antimonopoly Committee of Ukraine Aleksey Kostusev suspected the Russian oil companies TNK, "LUKOIL" and "Alliance" in creation of monopoly at the fuel market. However, according to the experts, the real picture of the branch testifies about the contrary. "We have six oil refineries operating in our country and one major gas-transferring plant. They all compete against each other. They cannot be referred to as monopolists, even more so that the laws do not contain such notion as collective monopolism», – says Igor Yeremeyev.

A number of leading operators of the retail market have raised the price for the A-95 by UAH 0.05-0.06. According to UPECO, the price for the A-95 in the fuel stations network of “LUKOIL” has grown from UAH 3,25 per liter to UAH 3,3 per liter over the weekend. The price for this grade of fuel has as well been increased to the same level in the fuel stations networks of “Neftegaz-Ecoil”, oil company “Alliance-Ukraine”, “Ukrtatnafta” andÒNÊ. At the same time in the fuel stations network “Klo”, which sells the oil products from ÒNÊ, the A-95 produced in Ukraine costs already UAH 3,32 per liter.

The supplies of the oil to the Ukrainian oil refineries in June have increased by 52,3% as compared with May up to 1 741 400 tons. The biggest volumes of oil in June were supplied to the Lisichansk Oil Refinery (LINOS, the Lugansk Region) 620 600 tons (3,5 times more than in May), of them Russian oil - 610 000 tons, Ukrainian oil – 10 600 tons.

ÒNÊ-ÂÐ Ukraine will not be a shareholder of the Open Joint Stock Company “Football Club “Zarya”. This statement was made at the press conference with the fans of the club by the Head of the Lugansk Public Administration Aleksey Danilov. He noted that in spite of that “ÒNÊ-ÂÐ Ukraine” will render one-time assistance to “Zarya”.

However, at present only big companies, bank institutions and foreign branch offices can allow themselves such an expensive pleasure. However, some companies hold conferences using solely video technologies. For example, LLC ÒNÊ-ÂÐ Ukraine holds videoconferences practically every day, and sometimes even up to five times a day.

Quotations of the Russian oil are of particular significance for Ukraine, since its consumption reaches 82% from the total amount. It is quite evident that the prices for the Russian “black gold” for the Ukrainian oil refineries will significantly increase as compared to July. For example, ÒNÊ-ÂÐ Ukraine contracts the oil for July at a price of $340 per ton, which is by 11% higher, than the contracts in March ($306 per ton).

A source in the Ministry of Fuel and Energetics informed that the Ukrainian plants increased the oil processing in June by 19,9% as compared to May up to 1 514 300 tons. In June only the Lisichansk Oil Refinery (LINOS) increased the oil processing – by 246,3% up to 549 500 tons.

The threat of increasing the prices for supplies of the Russian gas and transition to payments in money will for sure make one to reconsider many promises given at Maidan. According to some calculations, after threefold increasing of the price for the Russian as well as for the Turkmenistan gas, one cubic meter for the end consumer will cost twice as much. In its turn it will lead to increasing of the prices for electrical energy not less than by a factor of 1.5. Surely, the Russian business in Ukraine will as well have to reconsider its budgets in Ukraine. The price surge will as well affect the oil refineries in Odessa (LUKOIL), Lisichansk (ÒNÊ-BP), Kherson (“Alliance”) belonging to the Russian companies.

The Antimonopoly Committee of Ukraine made a statement, that the Russian enterprises ÒNÊ, LUKOIL” and “Alliance” jointly control the bigger part of the Ukrainian market of oil products. In the meantime the Ukrainian legislation says that only that company could be regarded as monopolistic which controls at least 35% of the market. At the same time the indexes of the Russian oil companies do not even reach that level. So, today “ÒNÊ” holds about 30% of the segment, the share of the Oil Company “Alliance-Ukraine” makes approximately 14-15%, while “Lukoil” controls only 10% of the market.

The other day the Head of the Antimonopoly Committee of Ukraine Aleksey Kostusev got suspicious of the Russian oil companies “TNK”, “Lukoil” and “Alliance” trying to create monopoly at the fuel market. However, according to the observers the real situation in the industry supports the contrary. Standards of highway construction nowadays require new technologies, modern equipment and high-quality construction materials. The latter are very often imported from other countries. However, the Ukrainian manufacturers of the bitumen insist – the domestic product is capable to satisfy all requirements of the highway construction companies. After a new bitumen unit was commissioned at the Lisichansk Oil Refinery they started to manufacture products which are not inferior to the foreign bitumen.

After the spring fuel crisis the prices at the fuel stations have grown, in spite of the efforts of the Government to keep them from growing. Today they stay stable so far. But already now many experts say that we should expect another price growth for the oil products.According to Ivan Plachkov, the Minister of Fuel and Energetics of Ukraine, in July the Russian crude oil is supplied to the Ukrainian oil refineries at a price of $350-$360 per ton, that’s why the prices for the oil products will as well grow by 10%.

Last year the construction of the Ukrainian roadways consumed about almost 700 000 tons of bitumen; half of this volume was imported. In the meantime, the domestic producers insist that they are capable to completely satisfy the needs of the Ukrainian market. For example, the Lisichansk Oil Refinery alone could produce almost 400 000 tons of this product in a year. LINOS not only built a perspective bitumen production, but as well established very good logistic schemes of supplies.

The article of the People’s Deputy, representative of the Communist fraction of the Parliament Vasiliy Sirenko. According to his opinion one of the most outrageous examples of the mass plunder of the citizens is exactly the situation at the oil products market. “Having sold for nothing the common property of the people – national oil refineries – the State is just unable to balance the situation at the oil products market. The situation at the oil products market is a consequence of reckless privatization of the Ukrainian oil refineries with a huge number of law violations. One of those oil refineries is the Lisichansk Oil Refinery”, - says Comrade Sirenko.

“For sure this decision will improve the economy of the Yuzhniy, but will not equalize the prices of its services with those of the Odessa port”, - said the Vice-President of “ÒNÊ-ÂÐ Ukraine” Alexander Grabovsky. He underlined that the harbor dues at the Yuzhniy Sea Oil Terminal were twice as much as the dues at the Odessa port before the decision about discount was taken. Alexander Grabovsky noted, that as before “ÒNÊ-ÂÐ Ukraine” believes that to make the route Brody-Odessa more attractive the Ministry of Transportation has to render 50% discount for the harbor dues of the Yuzhniy and added that his company would carry on working in this direction.

The Lisichansk Oil Refinery increased the production of gasoline by a factor of 5,2 – up to 168 400 tons (residue – 42 900 tons), diesel fuel – by a factor of 5 – 144 900 tons (residue – 21 800 tons), black oil – by a factor of 4,3 -  157 200 tons (residue – 28 200 tons).

The Head of the National Joint Stock Company “Neftegaz Ukraine” Aleksey Ivchenko dreams about laying his hands on the Lisichansk Oil Refinery. Such conclusion can be made after analyzing all his statements about necessity of revision of the privatization of this enterprise. According to Mr. Ivchenko the enterprise was sold at a very low price. However, he does not mention the fact that having bought the Lisichansk Oil Refinery the actual owner – the Russian-British company “TNK-BP” – not only did receive one of the leading enterprises in the oil processing industry of Ukraine, but as well assumed its huge debts and practically had saved it from its complete bankruptcy.

Peripeteias at the world oil products market do not directly influence the activity of the Ukrainian oil processing companies. However, the Ukrainian oil products market is directly dependent on the situation in Russia, where the prices for the “black gold” do not stand still and gradually start climbing. So according to the estimates of ÒNÊ–ÂÐ the Ukrainian oil refineries will have to pay for the raw material $350 per ton, while in Russia the oil will cost $250 per ton. There is no doubt that increasing of the wholesale prices will influence the cost of the fuel at the fuel stations.

On 1.07.05 LLC ÒNÊ-ÂÐCommerce was launched. This company is engaged in wholesale sales of the oil products at the territory of Ukraine. LLC ÒNÊ-ÂÐCommerce will be carrying out solely operational functions — gross wholesales, distribution, development of the jobber network, logistics, small wholesales, export, administration of the petroleum storage depots.

Open Joint Stock Company “Lisichansknefteorgsintez” (“LINOS”) believes that the investigation by the Pechersk Court of the action brought by Tatiana Laveykina about invalidation of privatization of the Lisichansk Oil Refinery is illegal, since the subject of the action is of an explicit economic character. Such statement was made by Viacheslav Peskov, the representative of the Open Joint Stock Company “LINOS” in the court.

As opposed to July the results of the branch in June have formed already. Instead of 1.8 mln tons of oil of the overall amount of processing which were announced by the oil refineries earlier this month the plants have processed only 1.5 mln tons. The overall results were influenced in the first line by the shutdown of Drohobych Oil Refinery for repair works. Besides, the oil processing at the Odessa Oil Refinery and “Neftekhimik Prikarpatya” dropped down. The only enterprises which sustained the production in June at more or less stable level were “Ukrtatnafta” and LINOS.

The Antimonopoly Committee of Ukraine has completed the revision of the work of the economic entities operating at the national wholesale trade markets of gasoline and diesel fuel. The Press Department of the Antimonopoly Committee of Ukraine informed that after the thorough scrutiny of the received information in August the Committee would hold a public hearing on the investigation results.

Russian-British ÒNÊ-ÂР will sell the oil products at the territory of Ukraine independently. The new company of the international holding TNK-BP in Ukraine - LLC “ÒNÊ-ÂÐ Commerce” – was launched on July 1, 2005. LLC “ÒNÊ-ÂÐCommerce” was created in April, 2005 after the second stage of restructuring of the Ukrainian assets of ÒNÊ-ÂÐ. Felix Lunev was appointed the General Director of LLC “ÒNÊ-ÂÐCommerce”. The company’s stuff amounts to 100 employees.

Tatiana Laveykina disputes the legitimacy of privatization of the Lisichansk Oil Refinery (Open Joint Stock Company “LINOS”) by “TNK-Ukraine Invest”. Violation of rights of Tatiana Laveykina lies in the fact that she was not admitted to the competition as a physical person. The lawyers of LINOS believe that the judge of the Pechersk District Court Elena Umnova was not entitled to entertain such an action, since privatization issues are within the jurisdiction of the economic courts, and not of the courts of general jurisdiction. Tatiana Laveykina herself refuses to comment on her claims, saying that these are very clearly and in details written down in the statement of the action. She keeps silence as well about whether she has sufficient money to purchase such a big enterprise. In this connection a question arises: perhaps there are some big business structures standing behind Tatiana Laveykina?
